Royalty Free Music (“we”, “our”, or “us”) operate the Royalty Free Music platform at royaltyfreemusics.net (the “Platform”). Please read these Terms and Conditions (“Terms”) carefully before using our Platform. By accessing and using the Platform, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the Platform. We reserve the right to modify or update these Terms at any time.
"Background Music"
Music that is used in connection with visual and/or other audio material where the music serves a secondary role. You may not create a derivative music track and claim it as your own music, even if the music has been transformed or edited, or if you have added other instruments or vocals to the music.
"Attribution"
Include the full artist name and track title of the used music track in your video description. An example of correct attribution will be provided upon download of each music track on the Platform.
"User Generated Content"
Any form of visual and/or audio material created and published by an individual on social media platforms such as, but not limited to, YouTube, Instagram, TikTok, Facebook, Twitch, Vimeo, and Twitter.
"Commercial Purposes"
Any form of paid advertising and/or any form of visual and/or audio material published by a company/entity or on behalf of a company/entity. Please note that you are allowed to monetize your User Generated Content on platforms such as, but not limited to, YouTube as long as you include the correct Attribution in your video description.
Royalty Free Music grants you a non-exclusive, worldwide copyright license to download and use the music available on the Royalty Free Music Platform for free as Background Music for your User Generated Content, except for Commercial Purposes, as long as you include correct Attribution. This license does not include the right to sell, transfer, sublicense, share, distribute, or give away the music.
If you as an individual or on behalf of a company wish to use our music without including Attribution and/or for Commercial Purposes, then you must purchase a license from our shop. In case you are unsure about what license you should get, or if you need to buy a license at all, then you will be able to find more information.
The Platform is intended for users who are at least 13 years of age. If you are under 13, please do not use our Platform.
You may not use the music in association with any activities that are illegal or prohibited, including, but not limited to, the promotion, endorsement, or incitement of hate, discrimination, or violence of any kind. You may not create a derivative music track and claim it as your own music, even if the music has been transformed or edited, or if you have added other instruments or vocals to the music. You may not sell, transfer, sublicense, share, distribute, or give away the music as standalone files or as part of a music compilation. You may not claim to be the creator or copyright holder of the music.
The music, logos, trademarks, UI, and all other intellectual property associated with the Platform are the property of Royalty Free Music.
Use of our Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
To the fullest extent permitted by law, the Platform shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
You agree to indemnify and hold harmless Royalty Free Music and its officers, directors, employees, and agents from any claims, disputes, demands, liabilities, damages, losses, and costs arising out of your use of the music or violation of these Terms.
We reserve the right to terminate or restrict access to our Platform, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
Royalty Free Music is operated from Spain. If you access the Platform from outside Spain, you do so at your own risk and are responsible for complying with the laws and regulations of your jurisdiction.
Any disputes arising out of or related to these Terms or the use of the Platform will be governed by the laws of Spain, without regard to its conflict of laws rules.
